WebIn the State of Ohio, the Medicaid Estate Recovery Program (referred to as “MER”) is authorized by O.R.C. 5162.21 which authorizes (usually through the Attorney General's Office) the recovery of the cost that Medicaid paid for the long-term care services of the deceased individual. WebEffective: September 29, 2013 Latest Legislation: House Bill 59 - 130th General Assembly (A) Except as provided in division (B) of this section and section 5162.23 of the Revised Code, no lien may be imposed against the property of an individual before the individual's death on account of medicaid services correctly paid or to be paid on the individual's behalf.
